Perez Hearing Underway – First Amendment Rights, Not Racial Descrimination

Around 9:45, Hicks asked Nichols about a recording an employee’s spouse made about a rumored Perez candidacy  for sheriff.

Around 9:40 a “misunderstanding” between Perez and the jail administrator was discussed, and their duties were described as “separate, but equal,” with Perez over patrol deputies, and her over all jail operations.

At 9:30, Hicks called his first witness, Sheriff Tim Nichols, about Perez’ appointment as chief deputy, and the duties of a chief deputy.

At 9:20, Hicks again pointed to Perez’ right to political free speech, including Perez’ thoughts of running for sheriff in the future.

At 9:15, Atty. Hicks corrected Gibson’s statement about the type of discrimination involved in the case, alleging that Nichols’ attitude toward Perez changed upon hearing that Perez was considering running for Sheriff for the next term.  It was not racial in context.

At 9:10, county attorney Cliff Gibson began his opening comments, stating that the grievance committee must decide if Perez’ termination was illegal, based on racial discrimination.

At 9:05, 10 witnesses were identified by Sheriff Nichols.  3 were named by Perez’ attorney, Rickey Hicks.

At 8:55, AM, all Justices of the Peace are present, and the grievance hearing is scheduled to begin.
