Around 5:30 this evening a Drew County jury found Jimmy Frost guilty of 1st degree attempted murder, committing a terroristic act, and being a felon in possession of a firearm.

At 8:30 p.m., they returned to the courtroom and recommended a sentence of 23 years for the 1st degree attempted murder charge, 10 years for the terroristic act charge, and 10 years for the felon in possession of a firearm charge.  They also recommended that Frost be allowed to serve all 3 sentences concurrently, which means a total of 23 years.

Jimmy Frost will likely be eligible for parole in 7-8 years.

As of 3:45 p.m., MonticelloLive was informed that the jury had gone into deliberations in this case.

Testimony ended before lunch Wednesday morning in the attempted capital murder trial of Jimmy Frost, who is accused of shooting his wife of 30 years, Vanessa, once in the head and three times in the chest on October 22, 2007.  Frost is also accused of committing a terroristic act, and could receive a life sentence in this trial.

Tuesday’s court time was spent with opening arguments, and with the presentation of the prosecutor’s case.  The day came to a close with around an hour of the defense’s case.

After Mrs. Frost had filed for divorce,  Mr. Frost wanted to ask her “to give us another chance”.  When the attorney spoke, “and she said ‘no'”, Frost responded, “she didn’t say nothing”.

Frost statements included;  “i was just staring at the (my truck’s) headlights, like the world had stopped.”  He added, “that’s when I seen Vanessa on  the ground,”  “between the door and the rocker panel.”  “I remember thinking to myself, she’s dead.”  Other statements about that time frame included, “She took a deep breath and let it out.  I just kept staring at her.”

Frost said that he didn’t remember anything else, and that he didn’t want to kill his wife, because he “breathed into her mouth” and also called 911.

Frost, when questioned, admitted to numerous physical altercations with Vanessa, over around a 10 year span, and said that these confrontations were over his jealous, among other things.

Frost had been on probation for other charges, at the time of the shooting. 

Frost was asked if he remember speaking with a deputy, and he responded, “very little.”  When he was asked if he remembered telling the deputy that took him to jail, “She left me no other choice,” again replied, that he didn’t remember that statement.

A couple more issues were discussed before the morning came to an end, and jury instructions were then approved by Judge Sam Pope, before the court broke for lunch.

The jury heard Tuesday what was included on the 911 tape, which included several call from Mr. Frost.  His recorded words included, “I’ve shot my wife”, “Would you please hurry”, and “she needs help.”

The jury began hearing instructions around 12:45, and deliberations began shortyly before 3:45 p.m.

Leading issues the jury will decide on are if this was a planned and deliberate act, as well as the affirmative defense of “renounciation”.

Drew County Man Facing Full Mental Evaluation Before Going to Trial for Shooting and Stabbings

The case of Jimmy Lee Frost was heard before the Drew County Circuit Court Tuesday, and he was ordered to undergo a full mental evaluation for both of the cases he is facing; a September, 2007 case where he attacked his wife and a former resident with a knife, and shooting described in the  October, 2007 MonticelloLive.com story below.

Both cases have been continued, awaiting the outcome of the mental evaluations.

Shooting North of Monticello Results in Attempted Murder Arrest

Monday night, Oct. 22, at 10:56 pm, a call came in to the Drew County Sheriff’s Dept., reporting a shooting on highway 425 north of Monticello, in the Montongo area.

At the scene, Jimmy Lee Frost was arrested for shooting his wife, Vanessa, 3 times.  The victim is hospitalized and is undergoing surgery.

Frost has been charged with attempted murder, 2nd degree, and domestic battery, 1st degree.  He had reportedly, recently bonded out on other domestic charges.

According to Lt. Rick Rausch, Criminal Investigative Detective, Drew County deputies David Wesson and Rex Davis were the first to arrive on the scene, who arrested Frost.

Also on the scene were Sheriff Mark Gober, Chief Deputy Robin Hood, and Lt. Rick Rausch.   

The victim was transported to the hospital by ambulance, and the weapon was recovered.
