The Fight, before the Fatal Shot

Attorney John Frank Gibson repeatedly told the jury to consider Riley had emotional distress during the ordeal.
Gibson described the events that day as,
Josh Martin had been going at it with someone else in the area.
Martin began yelling obscenities at Riley, renewing an old issue between the pair, involving the females in their lives.
Riley got out of the car to argue.
Martin “whooped him all over the yard.”
Martin, age 26, beat Riley, age 60; winning “2 rounds, and getting ready for round 3.”
