Wilmar Asphalt Truck “Death Driver” Ticketed for Truck Safety Violations, Again

005On October 29, 2012, Elizabeth Ann Davis, age 66 of Warren, was waiting for a train to pass, at the Wilmar train crossing, when suddenly her life came to an end, as a loaded asphalt truck barreling down the highway behind her crashed into her mini-van, killing her instantly.

Bryant R. Childs (then age 30 of Warren), was found guilty of negligent homicide for her death,  and 5 counts of 2nd degree assault for injuries to other people waiting on the train to pass that day.

Testimony in the 2013 court case revealed that Childs’ jumped from his loaded asphault truck, which crushed Mrs. Davis’ mini-van into another 18-wheeler, in the 6 vehicle collision.

The trial seem to focus on Childs’ ability to control his loaded big rig, while his defense claimed that it was not his responsibility for its inspection and safety.

It seems that Childs still doesn’t inspect 80,000 pound vehicles before driving them.  On January 19, of this year, Childs’ was ticketed for unsafe/insecure load and overlength load, during an Arkansas Highway Police inspection.Driver control?)” and , “Who is responsible for inspecting his trucks, except for the Arkansas Highway Police?”

    Before a driver can get a CDL he must prove that not only can he drive, but he can perform a pre-trip inspection. All truck drivers must perform a pre-trip before taking a truck out on the road. If it is unsafe, he must get it fixed before driving. Every licensed truck driver knows this. How is he getting away with not inspecting the truck??

    They is just terrible….my father was a truck driver for many of years and he has never got behind the wheel without doing a check of the truck and trailer before driving anywhere. Drivers like this give other safe drivers bad names….i respect truck drivers so much and something needs to be done about this one!!!

    People on here always ready to bash others but how many on here text and drive or drink and drive or anything else that’s illegal or a destraction. Not taking up for him just tired of everyone bashing others.

    It seems that he was may have been driving a log truck I’m not sure but if any of you people that are bashing this guy have ever driven one you would know that this can happen any time when the loaderman loads the truck the sticks have to be so many feet beyond the rear of the trailer and by eyeballing it he may have thought it was ok and as far as not securing a load one of his straps may have been not tight enough but if you look at log trucks chip trucks dump trucks and even your personal vehicle a law man can find something wrong with it even if it just came off the show room floor. This man is just trying to make a living and assuming trying to pay back some off those fines just as truck driver says you have people that drive drunk text and had accidents that were involved in fatalities and then still drive so why can’t he

    Kill someone while driving sure keep your CDL. Obviously no prison time since he is still on the road. Stupid let’s see if something is done to avoid accidents like this ever occuring. Tragic situation, missed up justice system. I agree no one is a perfect driver and I shouldn’t be bashing anyone. Just my opinion, and we have the right to express it “@truck driver.” Be safe on the road everyone! This guy should have some punishment “driver probation” or revoked CDL reduce driving prilages.

    First, if Joe would make an attempt to be a real reporter/Journalist and get out his feelings he would report the whole story. I would assume he was sitting right in the court room. Facts.. Both famlies hugged each other and said it was an accident.. The judge let him keep his CDL etc.. Did Joe B forget to report that along with his reporting? For everyone that have a problem with the outcome its 3 things you can do..1.Get rid of your proscuting attorney.2.Get rid of your judge…That you all elected…3.Are you can just shut up, complaining about something you cant do anything about…I dont know this man, nor defending him but I wonder if good old boy Joe B would be giving anything else his unworthy attention…
