On Monday, James Edward Green, Jr., was convicted of Failure to Register as a Sexual Offender, and Registered Sex Offender Living Near a School or Daycare, by a jury in the Drew County Circuit Court.

Green still faces drug charges from an arrest last week, while he was out on bond, for this trial.

He was sentenced to 30 years in the Arkansas Department of Corrections and fined $250.00 on the Failure to Register charge and 15 years in the Arkansas Department of Corrections and a $250.00 fine on his conviction of Living Near a School or Daycare.

The jury recommended that these sentences be served consecutively to a total sentence of 45 years.

Judge Wm. Randal Wright, from Hope was the presiding judge. All of the Tenth Judicial District Circuit Judges found it necessary to recuse from this case because of legitimate conflicts and the Defense had requested their recusal. The Defendant was represented by Mr. Jack Kearney from Little Rock.

Testimony from MPD’s Lt. John Dement, who led the investigation into this crime, showed that the defendant was a Level Four – Violent Registered Sexual Offender and that he had moved without properly notifying authorities. Upon locating his new address, MPD discovered a daycare much closer to the residence than the required 2000’ of separation that is required of Level Four – Violent Sexual Offenders.

Green’s former parole officer confirmed to the jury that the Green was a Level Four – Violent Sexual Offender.

Drug Task Force officers were responsible for bringing Green into custody.

The cooperation between the Monticello Police Department, the Probation and Parole Office, the Arkansas Crime Information Service, and the Tenth Judicial District Drug Task Force was essential in the prosecution of this case.
