Victim in Nursing Home, Felon Gets Fine

A Drew County jury found Robert Carr guilty of second degree battery, last week, in the trial following the June ’08 confrontation with Eddie Baines, which left Baines as an invalid, unable to eat, talk, or be able to communicate with his family, as he is now confined to a nursing home.

After finding Carr guilty, the returned with sentence of no time to be served, and a fine of $7,500, and restitution of $2,500, which will go to cover medical expenses.

Carr had been charged as a habitual offender, since he had 4 other felony convictions on his record, and was on parole at the time, when he had struck Baines, and Baines had fallen and hit his head hard on the pavement, causing his injuries, and leading to brain swelling and surgeries.

Prosecuter Frank Spain told the jury, duing the sentencing phase of the trial, that, ” Mr. Baines is serving a life sentence, and will be in this condition until he dies.”

Carr’s attorney, John Frank Gibson, pointed out that, “Mr. Carr reacted to the situtation, and he over-reacted.”, claiming that Baines was also responsible for the altercation that June 10, 2008 evening.

Carr aploogized to the family, the prosecuter, and the court, before the final sentence was announced.

Carr’s lawyer, John Frank Gibson, told MonticelloLive that he was, “very pleased with the sentence,” adding, “they saw fault on both sides.”

 Monticello Man Remains on Life-Support After Last Weeks Street Fight

As of Wednesday afternoon, Eddie Baines, age 54, of Monticello remains in critical condition at Jefferson Regional Medical Center, in Pine Bluff.  Baines is still on life-support, and has shown no signs of improvement.

Another Monticello man, Robert Carr, age 48, was arrested and charged with First Degree Battery, was being held on a $50,000 bond, but has been released.

According to Monticello Police Dept. investigator, John Dement, the injuries to Baines occurred around 7:30, Tuesday night, June 10,  during a fight on Shelton Street, near Vinegar Hill.

Carr hit Baines in the face, causing him to fall to the pavement.  It is unclear whether the impact from the fist or the fall caused Baines’ injuries.
