Defendant Released When “Beating Victim” Tells Courtroom He Wasn’t Beaten & “Send Me $100”

May 26th, 2011 by

Ramien Collins was on trial, Wednesday, on 2nd degree battery charges, for the alleged beating of Mario Gilbert on October 8, after Gilbert had entered Collins’ parents home with a “sawed off shotgun”, forcing 3 men outside the residence to go into the Florence Road home with him.

Once inside, Gilbert testified that he, “tried to shoot him (Collin’s step-dad),  but he pushed the gun up to the ceiling.”

Since the shotgun was only a “single shot”, the 3 older men were able to overpower and “beat down” Gilbert. They then tied his hands with a nearby dog’ leash.

Someone then called Collins, who quickly arrived at the scene.  Collins twice loaded the tied man into the back of his pick-up, to take him “to the jail”, but Gilbert kept getting out of the truck.

Collins then allegedly began beating the already bloodied Gilbert, while his hands were still tied behind his back, with  “long, black weapon” (believed by authorities to have been Gilbert’s shotgun).

Deputy Frank Spain, representing the state, admitted during the calling of the jury, that the victim was a “career criminal”, but that Collins did not have the right to beat a helpless man, regardless that he was attempting enter his parent’s home at the time.

When asked if a person has the right to “extract some revenge” on someone breaking into your home, one man said “absolutely”.   Several other potential jurors began to agree.  The man who spoke up first was later dismissed from the jury for the day.  During Gilbert’s testimony, he admitted to attempting to rob the men, and that he tried to shoot the man, but when he as asked if Collins had beat him, he responded ‘No”.

Spain immediately asked Judge Sam Pope to dismass the case, telling the court that Gilbert had changed his story, from what he had said up to 2 hours ago.Family and friends of Ramien Collins began to cheer and clap, but were silenced by the court.

As Gilbert was led out of the courtroom, to return to ADC Cummins Unit, he told Collins’ supporters, “Send me $100.”

Attorney Greg Robinson represented Collins.
