Gun Drawn, Shots Fired, During Neighbors Dispute

January 5th, 2010 by

According to Drew County Sheriff Mark Gober, deputies were dispatched to a disturbance call on January 1 at approximately 10: 15 pm at 119 North Cominto Road.

Deputies spoke to a resident of the address, who stated that he and a neighbor, Tony Simmons, had gotten into an argument. During the argument Simmons is alleged to have put a gun to the man’s neck. He reportedly asked Simmons to let him go home. Simmons released him, and then fired a shot into the air.  The victim also states that Simmons later drove by his house and asked if he had called the law. Reportedly, the man stated “yes” and again Simmons fired three shots into the air and then drove to Monticello. Deputies advised Monticello Police Department to be on the lookout for Simmons.

Moments later, Monticello Police Department had located Simmons and taken him into custody. A search of Simmons’s home led to the recovery of a .380 handgun which later turned out to be stolen. Deputies also recovered a green leafy substance believed to be that of marijuana and a set of digital scales.

Simmons was placed in Drew County Detention Facility charged with aggravated assault, terroristic threatening-first degree, possession of a controlled substance with intent to deliver, simultaneous possession of drugs and firearms, possession of firearm by certain persons, theft by receiving, possession of drug paraphernalia, and endangering the welfare. District Judge Ken Harper set his bond at $10,000.

  1. john says:

why was the bond set so low? that is why we have so much junk on the streets. it should be jail time at the time of being pick up .until trail

  2. lookout says:

here we go again another gun slinger with a low low low bond. what is wrong with this? next time it might be a body they are picking up all thanks to a low low bond

  3. ree says:

By a certain person? What does that mean and endangering the welfare of what or who?

  4. Dragonheart says:

Is $10,000 the norm for Drew County? I know I would be a bit worried if I was that guy who was threatened. Might want to move…

  5. Lilly says:

    Isn’t he already a felon?

  6. justice4all says:

Someone please correct me if I am wrong on this, according to this article:
“The victim also states that Simmons later drove by his house and asked if he had called the law. Reportedly, the man stated “yes” and again Simmons fired three shots into the air and then drove to Monticello.”

Reading further down the article states:
“A search of Simmons’s home led to the recovery of a .380 handgun which later turned out to be stolen.”

So did Simmons drive to Monticello after firing the three shot into the air, or did he go back home to hide the gun then drove to Monticello? There are holes in this story the size of Texas…besides isn’t it innocent until proven guilty and not the other way around? Sounds like another case of our justice system at its finest!

  7. the truth seeker says:

very good point justis4all. the truth will set tony free. Its amazing we only have the victim”s side of the story, as everyone is well aware there are two sides to every story. Unfortunately I believe this story has three sides, the victim’s side, the defandant’s side, and the TRUTH.

I would like to hear updates in the investation of this story. How do we know this wasn’t a group activity that went wrong in so many ways? Who knows, maybe the victim was snitching on his friend to lower his punishment…..def something to think about since Tony and the victim were friends….mmmmmm
