DWI Appeal Forfeited When Defendant is Late for Court
November 29th, 2008 by Joe BurgessLast week, Randall Powell was scheduled to appear before Drew Circuit Judge Sam Pope, to appeal his conviction of DWI from Monticello District Court.
Powell’s appeal hearing was set to begin at 9:00. At 9:15, when Powell had not arrived, Judge Pope ruled that he had forfeited his appeal, and dismissed the jury.
Powell did arrive at 9:20, but the jury had already left the courtroom.
Aside from losing his appeal, Judge Pope also Powell to pay court costs, and re-imburse the court for the juror’s pay for the day.

WOW… It was nice the JUDGE gave him 15 min. before he forfeited.How can you appeal a DWI? The cop has you on that blowing thing tape? Will that hold up in court? wow what a Christmas he had. DON’T DRINK AND DRIVE!!!! if you do…. BE READY TO GET A DWI around here. I think the cops can smell a drunk comming down the road.
