Jury Hears Closing Arguments- Begins Deliberations

August 10th, 2018 by

murder trialCourt resumed at 1 pm, with lawyers and the judge discussing jury instructions, which were then read to the jurors.

Ag 1:40 m, the prosecutor Spain began addressing the jury, to which attorney Dale West objected.  There had been numerous objections throughout the trial.

When he began, again, he made a comment similar to, “let’s see how far we can get, without an objection.”  To that, West shouted, Objection!”  This was followed by both men being fined $250 for contempt of court.

Spain then summarized his case, and turned the podium over to Vincent’s other attorney, Mr. Humphrey, for his closing comments.

The defense summarized his case, but mentioned “P.C,” (probable cause) at 2 pm.  Spain asked for s sidebar, then Judge Pope told the jurors to ignore any mention. discussion or lack of probable cause.

The attorney told the jury that no one controlled Deputy Braden’s car, except for Deputy Braden.  He told that seatbelts weren’t being used and that the officer hit a light pole..

In the prosecution’s final statement, Spain suggested that the deputy was calling to report it as a pursuit, and ask for further instruction, since the vehicles had just reentered Barkada road and rapidly picked up speed.  He added that this was when Vincent through the bag of marijuana and money out of the car.

The jurors were shortly then dismissed to begin their deliberations.
